Hey, could someone help me make this hard decision?

Play the 80 now so you can participate in all the stuff with everyone else and then when the expansion comes out, reroll a new toon.
 
Blizzard specifically states that any account that you did not pay for - even if it is your own brother or sister's account is considered not a legal account.

I too had such an account that my brother gave me - but when I saw that this was against the rules I decided for the sake of integrity only to use the account that I paid for.
 
It is not a legality issue but it is against their ToS. It doesn't really matter who paid for it. You can be given WoW as a gift. But according to the ToS you are to be the original owner of any account you play.

I am certainly not an expert on law - but I always thought that anything that violates the ToS would be legal issue since it is legally binding to accept the ToS
 
I posted in the other thread... I say take the 80's and make another character on that account since you never got past 20 in the first place.

Also, as far as th ToS goes... more knowledgeable people than I have told me that the ToS' main purpose is to protect the company in legal binds.

Lets say I bought you the game and someone with no armor runs past you buck naked. you try to sue Blizzard because you saw that as morally wrong and very disturbing. You can't sue them because the ToS said you are to be the original account holder. You'd have to take that issue up with me.

Anyway, Joshinator I say take the account with the 80s and don't get offended by naked people.

This is taken directly from the ToS - This issue came up before in my previous guild and I cannot see any way that a Christian guild can endorse it even if it "hurts no one"

If that is the case, then really you should not be asking the Christian community this question. You may very well be asking for us to approve of something that is sin for you.
 
The way I read the TOS, it means you can:

Give your brother your account as long as:

They agree to follow the terms
They agree to pay for the account
They have taken possession of all the packaging and materials there in
And you have deleted the installation(s) related to that packaging from your computer.

That clause does not give you the right to sell it to your brother or to make payment for that account except transferor (i.e., you and not the brother), and not Blizzard, agrees to be solely responsible for any taxes, fees, charges, duties, withholdings, assessments, and the like, together with any interest, penalties, and additions imposed in connection with such transfer.
 
well they shouldnt have a problem with this cause they still get paid on the account instead of it sitting there and no one paying for it..
 
To answer your original question (rules aside) I would say to use the account that has the 80's on it. I would suggest if you do that though not to begin by playing those high level characters because you will feel lost and because people will think of you as an awful player. (not because you are bad, but simply because there is a lot you pick up as you play through the game and starting with all the skills can be a bit intimidating). So I'd start a new character on the account that has the 80's on it already and play the game that way. Then when you have a feel for the game and how everything works you will have some high level characters to mess around with later on.

You can always tell when someone gets an account with a high level character on it and starts playing them right away... 1. because they are terribad and 2. because they quickly lose interest in the game. If you use that account do yourself a favor and start from scratch initially. :)

Eh..... I may just give it back to be safe, and to experience leveling up by myself...
 
Yeah, I'd play the account with the lvl 80s in it. Try out the lvl 80s and see if u like them. Do some research and learn how to play them and try them out in some easy dungeons. If u feel like you're getting the hang of it, try some Heroics.

Your Lvl 80s probably has some decent gold and professions, so you should make lowbie alts on this server. Your Lvl 80s can mail gold, mats and gear to your low toons. Also, Lvl 80s can buy lvling gear, which u can send to alts, those things are awesome. It's painful to lvl a toon with no gold/lvl 80 feeding him.

I inherited a lvl 70 pally and it was awesome. :)

FWIW, even if they wanted to go through all the effort to drag it out, it would only be a civil issue and not criminal.
 
Ok I was really wondering about this so I decided to email Blizzard and ask the question directly based on my own RL situation.

Here is my original email:

My question is as follows: There is plenty of debate but I would like a clear answer from Blizzard. My brother had an account with several characters on it - he has quit playing. I have a legitimate account which I pay for that is not his. I have bought two accounts (purchased game discs from store) actually and only play with one at the moment. I was wondering is there a legitimate way in which I can pay for my brothers account and use it - if he no longer wants it? I don't want to violate the ToS and sometimes it is difficult to know what is legitimate and what isn't. I don't want to play his account and pay for it - if it is not acceptable but if he gives me his account and I have a second account I am not paying for would that qualify as an acceptable thing? If not I will simply continue to use my account. Thank you
